4. Usage Limits & Responsibilities
  • Each user is limited to a maximum number of music generation requests per second to ensure fair access for all users.
  • Users are responsible for the prompts they submit and must not attempt to bypass rate limits.
  • Do not generate harmful, offensive, or illegal content.
  • Accessing or attempting to access other users’ files or data is strictly prohibited.
  • Violations of these rules may result in suspension or termination of access.
4. Intellectual Property & Generated Content Disclaimer
  • Ownership of Generated Tracks: Our platform automatically generates music tracks using AI. We do not claim ownership of the tracks generated by users.
  • Potential Duplication & No Liability: The same or similar tracks may be generated for multiple users. We do not guarantee uniqueness.
  • By using our Services, you acknowledge and accept this risk and agree that we are not liable for disputes or claims arising from duplication.
  • If you require exclusive rights to a generated track, verify its originality and secure copyright protection.
  • helloTunez is not responsible for any legal claims, including copyright infringement.
4.1 Copyright Registration & User Responsibility
  • If commercializing a track, we recommend:
    • Verify that the track has not been previously generated or used.
    • Register the track with the appropriate copyright office.
    • Seek legal counsel for licensing, distribution, or copyright concerns.
  • We do not provide copyright registration services or verify originality.
5. Disclaimer of Warranties
  • Services are provided "AS IS" without warranties of any kind.
  • We do not guarantee uninterrupted or error-free service.
6. Limitation of Liability
  • We are not liable for any direct, indirect, or incidental damages arising from your use of our Services.
  • We do not guarantee that AI-generated music is original or unique. Due to the nature of AI, it is possible that the same or similar tracks may have been generated for other users or may resemble existing music available on platforms such as YouTube, Spotify, or other online sources.
  • Users assume all responsibility and risk for using AI-generated tracks, whether commercially or personally, including the risk of copyright claims, strikes, or disputes with third parties.
  • We are not liable for copyright disputes or financial losses from AI-generated music.
  • Users assume all risks using generated tracks commercially or personally.
  • Users waive the right to participate in class-action lawsuits against our platform.
  • helloTunez is not responsible for monitoring or policing the use of generated music by users, and we are not liable for any copyright disputes, claims, strikes, or content removals that may occur as a result of publishing or distributing AI-generated tracks.
  • By using our Services, users agree to indemnify and hold helloTunez harmless from any claims, damages, losses, or legal costs arising from the use of AI-generated music, including but not limited to claims made by copyright holders or online platforms.
  • Users waive any right to participate in class-action lawsuits against helloTunez related to the use, distribution, or commercialization of AI-generated music.
